Here at Teachers Service Commission we are committed to protecting your privacy.


1. Who we are and how to contact us

The Teachers Service Commission (TSC) is a constitutional Commission established under Article 237(1) of the Constitution. TSC has the following mandates under Article 237(2) and (3) of the Constitution: -

  1. to register trained teachers;
  2. to recruit and employ registered teachers;
  3. to assign teachers employed by the Commission for service in any public school or institution;
  4. to promote and transfer teachers;
  5. to exercise disciplinary control over teachers;
  6. to terminate the employment of teachers.
  7. review the standards of education and training of persons entering the teaching service
  8. review the demand for and the supply of teachers;
  9. and advise the national government on matters relating to the teaching profession.

2. What personal data we collect from you

a) Personal data

TSC collects and processes personal data collected directly from its employees. The personal data that we collect and process include: basic personal information, such as a data subject’s name; date of birth; contact information, such as a data subject’s postal address, email address and phone number(s); and any other personal data that is provided to TSC during the course of the performance of its functions.

b) Sensitive data

Sensitive Data TSC also collects directly and processes special category data such as your race, health status, ethnic social origin, conscience, belief, biometric data, property details, marital status, family details including names of the person’s children, parents, spouse or spouses, sex or the sexual orientation.


3. Why we collect the personal data from you

TSC processes personal data for a number of different purposes, which arise from its statutory powers, functions and duties. Some examples of the purposes for which TSC may collect personal data in accordance with its functions are:

a) Maintenance of Teachers Register – including personal data received from individuals who have applied for registration as a teacher.

b) Human Resource Functions – these includes data received directly from individuals to enable TSC carry out its human resource functions such as employment, posting to work stations, promotions, transfers and discipline of errant employees.

c) Service providers and suppliers – including personal data obtained from service providers or suppliers engaged by TSC.

d) Conferences, events and stakeholder forums – including personal data relating to attendees at conferences, events and stakeholder forums organized by TSC.

e) For internal statistical purposes.


4. Information We Share

We do not sell or otherwise disclose personal data collected except where we share with third-party for the following purposes:

a) Where the sharing of the personal data is necessary for the performance by TSC of its functions.

b) For the purpose of responding to statements by the Parliament.

c) For the purpose of legal proceedings.

d) In the case of service providers or suppliers to TSC.

e) For purpose of facilitating pension process and related activities therein.


5. How long we keep the personal data

We keep your personal data for as long as we need to. The retention period of your personal data depends on the purpose that we are using them. Once your personal data are no longer needed or you withdraw your consent where such was issued we will delete your personal data.

Further, in certain circumstances, the retention period of your personal data is based on legal and regulatory requirements to retain information for a specified period and on the relevant limitation periods for taking legal action.


6. Security of your personal data

We have implemented appropriate controls to protect your personal data against unauthorized access or accidental loss. You are required to set up a password in order to have access on some parts of our website. You must keep this password confidential at all times.


7. Your Rights related to the Personal Data we collect

You can contact our Data Protection Officer at dataprotectionofficer@tsc.go.ke with regards to the following rights over your personal data:

a) The right to be informed about the processing of your personal data;

b) The right to access your personal data;

c) The right to rectification of your personal data;

d) The right to erasure of your personal data;

e) The right to data portability;

f) The right to object to processing of your personal data; and

g) The right to restrict processing of your personal data.

When making requests regarding your rights above, we may ask for specific information from you to help us confirm your identity.
